Security Deposit

To secure the session, a 25% deposit is required from the CLIENT. This amount is non-refundable in case of cancellation by the CLIENT. The remaining balance will be due upon photo selection.

Cancellation

For outdoor sessions, in case of cancellation due to weather conditions, the session will be moved to a later date agreed upon between the PHOTOGRAPHER and the CLIENT or moved indoors (in studio or at home) in case of time constraints. Since weather conditions change rapidly, the session will only be rescheduled on the same day or the day before. In case of cancellation by the PHOTOGRAPHER, both parties will agree on a later date. In case of cancellation by the CLIENT, please inform me of any changes as quickly as possible by email. As much as possible, I remain very flexible and understanding. 

Use of photographs by the photographer

Unless otherwise specified by the CLIENT, permission is granted to the PHOTOGRAPHER to use the images as part of her photography business activities, including (but not limited to) publication on her website and social media, displays and advertising. The CLIENT consents to the use of images without additional compensation for an unlimited duration and acknowledges that this contract is irrevocable. If the CLIENT does not wish the images taken during this session to be used by the PHOTOGRAPHER or prefers that certain faces not be visible (for example, minors), please let me know as soon as possible. 

Use of photographs by the client

The digital files provided by the PHOTOGRAPHER are copyright-free for personal printing use only. The CLIENT is granted usage of the files processed by the PHOTOGRAPHER for personal promotional purposes only (web profiles such as Facebook, Instagram, etc.). The CLIENT agrees to credit the PHOTOGRAPHER. The CLIENT understands that they are not authorized to modify the photos provided by the PHOTOGRAPHER (for example, applying filters). The CLIENT understands that the provided images cannot be used for commercial, lucrative or advertising purposes. This includes the sale of images on stock photo banks (iStockphoto, Getty Images, etc.).

Injuries

The PHOTOGRAPHER is not held responsible in case of injuries including (but not limited to) falls & insect bites during the photo session. The CLIENT understands and accepts the risks and agrees to release and waive all past, present and future claims against the PHOTOGRAPHER as a result of their participation in the photo session.

Photographic style

The CLIENT confirms having viewed a sample of the type of work performed by the PHOTOGRAPHER and confirms being satisfied with the general photographic style presented. The CLIENT acknowledges that chosen locations, atmospheric conditions and subject participation result in variations in composition, visual environment and colors of the photographs. The PHOTOGRAPHER retains full creative license for the artistic direction of the photographs. If the CLIENT requests specific poses, it is important to inform the PHOTOGRAPHER before the end of the session since it will not be possible to resume the session.

Editing

All photographs undergo individual basic editing (tints, white balance, contrast, etc.). The image gallery contains approximately 85% of photographs in color processing and 15% in black and white. Some photographs may undergo additional editing at the PHOTOGRAPHER's discretion. Any editing requests from the CLIENT (blemishes, scars, distracting elements) will be evaluated and may result in additional fees to cover the extra workload. The CLIENT does not receive the unedited "raw" digital negative files under any circumstances.

Photo selection, final payment and gallery delivery

The client must pay the balance upon photo selection. The PHOTOGRAPHER has ten (10) business days to send the edited photos, with delivery time varying according to season and workload. The CLIENT will receive an email with instructions on how to download them. All images in the private web gallery are the best images of the session selected by the PHOTOGRAPHER.

File conservation 

The CLIENT's photos are available in private web gallery for viewing and downloading via my website's client access for a period of three (3) months. I also store all files on an external hard drive for a period of ten (10) years. If you lose your images for any reason during this period, please contact me so I can resend them to you.

Printing

The PHOTOGRAPHER does not recommend printing photos at express on-site labs (such as pharmacies). The CLIENT understands that low-quality printing may alter the colors and contrasts of the photographs. It is recommended to print photos at a professional lab.
